Thank you for choosing Quokka Pastry! 

Quokka Pastry is owned and operated by Quokka Pastry Pty Ltd  (thereafter: “Quokka Pastry” or “we”). By accessing, browsing, using or making a purchase on https://quokkapastry.com (thereafter: the “Website”), you agree to the Terms and Conditions (thereafter: the “Terms”) as set thereafter. 

Please read the following Terms carefully before placing your Order with Quokka Pastry , to avoid any disappointment. By placing an order with Quokka Pastry, you agree to be subject to the Terms as set out hereafter and signify your acceptance of these Terms.  

We may amend these Terms at our discretion with the amendment(s) becoming effective immediately. Please check these Terms regularly prior to using the Website and/or placing an Order with us to ensure you are aware of any changes. We will endeavor to highlight any significant or substantive changes to you where and when possible. 

Definitions

Custom order” means any order for a Product that is tailored specifically to you. 

Order” means any order for Products placed through the Website or through email. 

Price” means the price as listed on the Website. 

Product” or “Products” refers to any product that a customer can purchase from Quokka Pastry Pty Ltd. 

We”, “us”, “our” or “Quokka Pastry” individually and collectively refers to the business Quokka Pastry Pty Ltd. 

You”, “your” or “yours” refers to any person who visits, enquires and or purchases from Quokka Pastry Pty Ltd. 


Products

The Products are listed on the Website and include a description as well as the minimum order if applicable. 

Please note that the decorations and look of the Products may vary slightly from the image provided on the Website. Whilst we try our very best to replicate the images provided, this can only be done within reasonable limits. 

All our Products are gluten free. The allergens are listed on the Product page. Please read the caption carefully and email us at quokkapastry@gmail.com with any questions or concerns. We cannot be responsible for any incident involving personal food allergies. 

Custom order

We offer Custom orders for any special occasion. To get a quote, please get in touch with us at quokkapastry@gmail.com or through the contact us page with a short description of the cake you would like, any dietary requirements and the date you would need the Product for. 

Quotes for Custom orders are valid for fourteen days from the day of issue. A Custom order is not considered confirmed and no work on its creation will commence until a 30% deposit is paid and received. Once the deposit is paid, the quoted price is not subject to change, unless changes are made to the Order. The balance is due five days prior to the date that your Order is required. If placing an order within this five day period, then the full payment is due immediately. 

Any changes to the original quote is subject to a quote review of the requested amendments.

Image use

Quokka Pastry reserves the right to take pictures of your Order and use those images for, including but not limited to, the Website, advertising, Instagram, Facebook, without any form of compensation to you.

Pricing

All the prices are in Australian dollars. They are subject to change without prior notice. 

Payment

You acknowledge that, by placing an Order, you are agreeing to pay the Price for the Products that you order. In addition, you agree to pay any other fee or charges as set out in this Terms. 

We may change the Prices published on the Website without notice. Prices of Products placed in the basket but not paid for are also subject to change and you agree to pay the Price current at the time of payment. 

The accepted methods of payment are Visa, MasterCard, American Express, Apple Pay and Google Pay. The total amount of the Order is payable upfront for any Products shown on the Website. Payments are completed via our secure payment gateway. 

Payment is needed to confirm any order. Until payment is received, your Order cannot be guaranteed. 

Pick up

When you place your Order on the Website, you will be asked to choose a pick up location. 

Your order will be available for pick up on the date and time as set out in the Product description. 

Once you pick up your Order, please ensure the items are handled with care. Once the Products have left our care, we accept no liability for any damage that occurs in transit.

Damaged Products or incorrect storage

After your Products have been picked up, we take no responsibility for any damage that occurs to any part of said Product while it is in your care, including if it is as a result of incorrect storage. 

Cancellation and refund policy

All the Orders are baked to order and we do not accept returns. Refunds, credit notes or a replacement order to the same value will only be given if you receive the incorrect Products or if the Products that you received are shown to be of unsatisfactory quality. Should this be the case, or if you are in any way unsatisfied with the condition or quality of the Products, you must contact us within twelve hours of receipt and supply a picture of the damaged goods to quokkapastry@gmail.com. Quokka Pastry will not accept liability or any complaints made after this time. 

If you need to amend or cancel your Order, please contact us as soon as possible at quokkapastry@gmail.com. Orders canceled ten days or more before the pick up date will receive a full refund on the order total. Orders canceled within nine to five days of pick up date will be entitled to a fifty percent refund, and those canceled under five days of pick up date are not entitled to a refund. 

Intellectual property

All intellectual property, including but not limited to, uploaded files, designs, texts, graphics, articles, pictures and information contained on the Website are the property of Quokka Pastry and may not be modified, copied, distributed, reproduced, republished, displayed, downloaded in any form or by any means, in whole or in part, without our prior written consent. 

The trademarks and logos displayed on the Website belong to Quokka Pastry. Your use of any logo or trademark is strictly prohibited. 

Accuracy of content and liability

Quokka Pastry takes care and all precautions to ensure that the information provided on the Website is accurate. However, we cannot guarantee, nor do we accept any legal liability arising from or connected to the accuracy, the reliability, currency or completeness of anything published on the Website or any linked site. We do not, to the fullest extent permitted by law, will in any way be responsible for errors or misstatements or liable whether in contract, tort (including negligence) or otherwise for any loss or damage however caused. 

Force majeure and liability

If we are prevented from performing our services and delivery by circumstances beyond our control, including but not limited to strikes, accidents, acts of God, national or local disasters, damages to premises, weather, infectious diseases or similar events, then we will cancel your Order, refund you the amounts already paid and will then have no further liability to you. 

Privacy policy

Use of information you have provided us with, or that we have collected and retained relating to your use of the Website and/or our Products is governed by our privacy policy. By using the Website and purchasing the Products associated with the Website, you are agreeing to our privacy policy. 

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the Australian laws. If there is a dispute between you and Quokka Pastry that results in litigation, you must submit to the exclusive jurisdiction of the courts of New South Wales.
